The Local Government Act defines community land as land (other than roads) owned by Council or under Council's care, control and management. Freehold titled land owned by Council is not included in the definition and therefore exempt from the provisions of the Act.
The Act places obligations and responsibilities on Council on community land for the current and future benefit of the community.
The Act requires Council to have a community land register and management plans for community land.
A CLMP contains the following information:
A CLMP should be consistent with Council/Government policies, plans and development of the land.
It provides a framework for Council to manage and develop, for the enjoyment and well-being of residents, recreational and leisure activities on community land.
It allows Council to program and manage the maintenance of community land in a proper and orderly manner.
